1.1. These Terms & Conditions ("Regulamin") define the rules for using the online store operated by Marine Engine Service Dariusz Gumiński, with its registered office at ul. Poranna 13, 70-895 Zaton, Poland, NIP: 9551436927, REGON: 389601689, KRS: N/A — Sole Proprietorship (JDG), hereinafter referred to as the "Seller."

1.2. The online store is available at https://marinengineservice.com/ and operates under Polish law, including the Civil Code, the Act on Consumer Rights, and the Act on Providing Services by Electronic Means.

1.3. These Terms apply to all sales contracts concluded between the Seller and Customers (both Consumers and Business Customers) via the online store.

1.4. A "Consumer" is a natural person making a purchase not directly related to their business or professional activity. A "Business Customer" is any entity that is not a Consumer.

1.5. By placing an order, the Customer confirms they have read and accepted these Terms & Conditions.

2.1. The Seller offers the following products and services through the online store:

• Marine Crate Engines — new and remanufactured inboard and stern-drive engines
• Outboard Motors — new and refurbished outboard engines (Mercury, Yamaha, Suzuki, Honda)
• Marine Transmissions — gearboxes, sterndrives, and drivetrain components
• Suspension Systems — marine suspension and shock absorption systems
• Brake Systems — marine-grade braking components and assemblies
• Parts & Accessories — engine parts, maintenance kits, and consumables

2.2. The Seller also provides professional services including:

• Engine rebuilds and overhauls
• Dyno testing and performance calibration
• Professional installation and commissioning
• Transmission service and repair
• Seasonal maintenance and winterization

2.3. Product descriptions, specifications, and images are for illustrative purposes. Minor variations in appearance may occur. Technical specifications are provided by manufacturers and are subject to change without notice.

3.1. Orders can be placed through the online store 24/7 or by contacting the Seller directly at info@marineengineservice.pl or by phone at +48 123 456 789.

3.2. To place an order, the Customer must:

1. Select the desired product(s) and add them to the shopping cart
2. Proceed to checkout and provide accurate delivery and billing information
3. Select a payment method and delivery option
4. Confirm the order by clicking the "Place Order" button

3.3. The order confirmation email constitutes acceptance of the offer and conclusion of the sales contract. The Seller reserves the right to refuse an order in case of:

• Incorrect or incomplete Customer data
• Product unavailability
• Reasonable suspicion of fraudulent activity
• Previous violations of these Terms by the Customer

3.4. For high-value orders (exceeding PLN 50,000), the Seller may require a deposit of up to 30% before processing the order.

4.1. All prices displayed on the website are in Polish Zloty (PLN) and include applicable VAT unless otherwise stated. For Business Customers, prices may be shown net of VAT.

4.2. The Seller reserves the right to change prices at any time. Price changes do not affect orders already confirmed.

4.3. Accepted payment methods:

4.4. For international orders, the Customer is responsible for any customs duties, import taxes, and brokerage fees.

4.5. Invoices are issued electronically and sent to the email address provided during checkout. A paper invoice can be requested at no additional cost.

5.1. The Seller delivers products within Poland and to selected EU and non-EU countries. Delivery options and costs are calculated at checkout based on weight, dimensions, and destination.

5.2. Estimated delivery times:

5.3. Large items (engines, transmissions) are shipped via freight carriers on pallets. The Customer must ensure adequate unloading equipment and access at the delivery address.

5.4. The risk of loss or damage passes to the Customer upon delivery. The Customer must inspect the shipment upon receipt and report any visible damage to the carrier and the Seller within 24 hours.

5.5. If delivery fails due to incorrect address provided by the Customer or refusal to accept delivery, additional shipping charges may apply.

6.1. Under the EU Consumer Rights Directive and Polish law, Consumers have the right to withdraw from a distance contract within 14 calendar days without giving any reason.

6.2. The withdrawal period begins on the day the Consumer or a third party indicated by the Consumer (other than the carrier) takes physical possession of the goods.

6.3. To exercise the right of withdrawal, the Consumer must inform the Seller of their decision by an unequivocal statement (e.g., email or letter) sent to:

6.4. The Consumer must return the goods to the Seller within 14 days of notifying the withdrawal. Return shipping costs are borne by the Consumer unless the goods are defective.

6.5. The Seller will refund all payments received within 14 days of receiving the returned goods or proof of return. Refunds will be made using the same payment method used for the original transaction.

6.6. The right of withdrawal does NOT apply to:

• Goods made to the Consumer's specifications or clearly personalized
• Goods that deteriorate rapidly or have a short shelf life
• Sealed goods that have been unsealed after delivery for health or hygiene reasons
• Services that have been fully performed with the Consumer's prior express consent
• Digital content supplied on a tangible medium if the seal has been broken

7.1. Statutory Warranty (Rękojmia)

For Consumers, the Seller provides a statutory warranty under the Polish Civil Code. The Consumer has the right to:

• Demand repair or replacement of defective goods
• Demand a price reduction or withdraw from the contract if repair/replacement is impossible or excessively costly

The warranty period is 2 years from the date of delivery for Consumers.

7.2. Commercial Warranty (Gwarancja)

The Seller provides an additional commercial warranty on selected products:

• Normal wear and tear
• Damage caused by improper installation, misuse, or neglect
• Damage from racing, competition, or commercial use (unless specified)
• Damage caused by contaminated fuel, oil, or coolant
• Unauthorized modifications or repairs
• Damage from freezing, overheating, or lack of maintenance

7.4. Core Charge / Exchange Policy

For certain products (e.g., remanufactured engines, transmissions), a core charge may apply. The core charge will be refunded upon return of the original old part in rebuildable condition within 30 days.

8.1. If you receive a defective or damaged product, or if the product does not match the description, you have the right to file a complaint.

8.3. The complaint should include:

8.4. The Seller will acknowledge receipt of the complaint within 7 days and respond with a decision within 14 days of receiving all necessary information. Complex cases may require up to 30 days.

8.5. If the complaint is accepted, the Seller will cover the cost of return shipping. If the complaint is rejected, the Customer may pursue the matter through:

9.1. The Seller's liability for defective products is limited to the purchase price of the product, except in cases of:

• Personal injury
• Willful misconduct or gross negligence
• Fraudulent misrepresentation

9.2. The Seller is not liable for:

• Damage caused by improper installation, operation, or maintenance by the Customer or third parties
• Consequential damages, including loss of profits, business interruption, or damage to other equipment
• Damage caused by force majeure events (natural disasters, war, strikes, pandemics)
• Damage resulting from the Customer's failure to follow manufacturer guidelines

9.3. Marine engines and related equipment must be installed and serviced by qualified marine technicians. The Seller strongly recommends professional installation. Installation by unqualified persons voids warranty coverage.

10.1. All content on marineengineservice.pl, including text, images, logos, graphics, product descriptions, and software, is the property of Marine Engine Service or its licensors and is protected by Polish and international copyright, trademark, and intellectual property laws.

10.2. Trademarks such as Mercury, Yamaha, Suzuki, Honda, Volvo Penta, Cummins, Caterpillar, and others displayed on the website are the property of their respective owners. Their use does not imply endorsement.

10.3. You may not reproduce, distribute, modify, or create derivative works from any content on this website without prior written consent from the Seller.

11.1. These Terms & Conditions are governed by the laws of the Republic of Poland.

11.2. The Seller is committed to resolving disputes amicably. If you are dissatisfied with our response to a complaint, you may use:

• Mediation: Through a certified mediator agreed upon by both parties
• Arbitration: Through the Polish Chamber of Commerce arbitration court
• EU ODR Platform: https://ec.europa.eu/consumers/odr/

11.3. For Consumers, disputes may also be resolved by the competent common court in Poland. The court with jurisdiction is determined by the Consumer's place of residence.

11.4. For Business Customers, the competent court is the court having jurisdiction over the Seller's registered office.

12.1. These Terms & Conditions enter into force on 25 August 2026 and apply to all orders placed from that date.

12.2. The Seller reserves the right to amend these Terms at any time. Changes will be published on this page with an updated effective date. Orders placed before the change remain governed by the Terms in force at the time of ordering.

12.3. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.4. These Terms do not limit or exclude any rights granted to Consumers under mandatory provisions of Polish or EU law.
